AI ethics & algorithmic bias: The new governance frontier

As India integrates AI into justice and welfare, the challenge shifts from building tech to coding ethics

The concept

​Algorithmic bias occurs when AI systems produce systematically prejudiced results due to flawed underlying data or skewed programming. In 2026, as India deploys Sovereign AI like BharatGen, the focus has shifted toward “Responsible AI”. This is governed by the IndiaAI Governance Guidelines (2025), built on seven “Sutras”, including fairness, accountability, and being understandable by design.

Why it matters

Judicial risks: AI tools used for case summarisation or legal research (like Sansad Bhashini) must be guarded against “hallucinations” and “Black Box” reasoning, where the logic behind a suggestion is opaque to judges.

Welfare exclusion: If algorithms for identifying beneficiaries (e.g., in PM-Kisan or PDS) are trained on historically skewed data, they may inadvertently exclude marginalised communities, turning digital tools into barriers.

The Black Box problem: In high-stakes areas like policing or sentencing, the inability to “audit” an AI’s decision-making process violates the fundamental legal principle of Principles of Natural Justice.

Key guardrails

Human-in-the-loop (HITL): Ensuring that AI only assists, and never replaces, final human judgment in critical sectors.

Techno-legal audits: The AI Safety Institute (AISI) now mandates regular bias-checks and “Red Teaming” (simulated attacks to find flaws) for high-risk models.

Way forward

​India is pioneering a “Risk-Based Approach”, where low-risk apps face light regulation, but high-impact AI (like those used in healthcare or law) must undergo mandatory Ethical Impact Assessments.

​AI ethics is not a hurdle to innovation but the foundation of public trust. By embedding transparency into projects like Bhashini, India is ensuring that its “Digital Stack” remains both smart and fair, setting a global standard for inclusive, human-centric technology.
